Terms of Service

"Anna Mozgovaya" (the website annamozgovaya.com) is the personal website of the writer Anna Mozgovaya. Anna Mozgovaya publishes her own works here and also gives her friends and registered Users the opportunity to publish their own works on the Site. The Site was created outside of politics, for entertainment and educational purposes only.

By using and/or visiting the website annamozgovaya.com (including all content available through the domain name annamozgovaya.com and all of its subdomains), you express your full and unconditional acceptance of the terms of this Terms of Service (hereinafter, the "Agreement"). If you do not agree to any of the terms of this document, please do not use the Site.

We may, at our discretion, amend or revise the terms of the Agreement at any time. The current version is always available at this same address. By continuing to use the Site after such changes, you agree to them. The terms of the Agreement apply in full to all Users of the Site.

Definitions

Site — the set of visual elements, text, and materials organized into sections and pages located on the domain annamozgovaya.com and its subdomains.

Administration and/or We — Roman Mozgovyi, a private individual, the owner and person managing the Site. The Administration can be contacted via the feedback form on the Site, and for questions regarding the processing of personal data, at privacy@annamozgovaya.com.

User — an individual registered on the Site in accordance with the terms of the Agreement, who has reached the age required to accept it.

Work and/or Author Content — literary works or parts thereof (including unfinished ones), protected as copyrighted works, recorded in digital form and published by a User on the Site.

Author — Anna Mozgovaya or another User who has posted a Work on the Site for access by other Users under the terms offered by the Site's functionality.

Publication — a User making it possible for any persons, at any time and from any location, via the Internet, to access a Work posted on the Site.

Rabbits (RabbitCurrency) — the Site's internal unit of account, which is not electronic money, a means of payment, or a cryptocurrency. Rabbits are credited to a User upon topping up their balance with real money at a rate set by the Administration, and may be spent exclusively on unlocking access to Works on the Site at the price set by the Author.

Payment Provider — Mollie (Mollie B.V.), the company through which payments in real money are processed on the Site. The Administration does not receive or store the User's bank card details or other payment instrument data — all payment information is processed directly by the Payment Provider in accordance with its own terms of use and privacy policy.

Registration on the Site

Registration of a User on the Site is free and voluntary.

You may browse part of the Site without registering, but access to certain features (publishing works, comments, the forum, saving your reading position, payments and purchases) requires a user account. When registering, you must provide accurate and up-to-date information (username, name, email, password). You bear sole responsibility for the accuracy and currency of this data.

Your username and password are the necessary and sufficient information for accessing your account. You are required to keep them secure. Any actions performed using your username and password are deemed to have been performed by you, unless proven otherwise. Any unauthorized access to your account must be reported to the Administration without delay.

You must be at least 16 years old to register on the Site, including to make payments. By making a payment on the Site, you confirm that you have the legal capacity required under applicable law to enter into such a transaction on your own, or that you have obtained the consent of your legal representative to do so.

Registration involves the processing of your personal data (name, email, username, and other data provided while using the Site, including data related to payments — see the "Payments and Purchases" section below) — the terms of such processing are set out in a separate Privacy Policy, which forms an integral part of this Agreement.

You may request deletion of your account from the Administration at any time. Upon deletion of your account: Works you have posted as an Author remain on the Site by default (unless you have explicitly asked for them to be deleted as well — in which case the rules of the "Intellectual Property Rights" section also apply); comments and forum posts you have left may remain on the Site in anonymized form, without being linked to the deleted account; access grants to Works previously issued to you are cancelled together with the account, except for access previously acquired for money or Rabbits, which is retained in accordance with the "Payments and Purchases" section; any unspent Rabbits remaining on your balance are non-refundable upon account deletion initiated by the User, unless otherwise required by applicable law. Certain data, including records of payments made, may be retained for some time in backups and accounting records for technical and legal reasons.

Use of the Site for reading, commenting, and publishing works is free of charge. Certain paid features are described in the "Payments and Purchases" section.

Access to Works

Some Works on the Site are open for free reading. An Author may restrict access to a Work or part of it starting from a particular chapter: from that point on, the remaining text is available only to Users who have been granted access — free of charge (by the Author or the Administration, manually, by the User's identifier or email, for a fixed period or indefinitely) or on a paid basis, under the "Payments and Purchases" section below.

The price for access to a Work is set by the Author at their own discretion. The Administration does not review or guarantee that the price set corresponds to the volume, quality, or content of the Work.

Payments and Purchases

Two ways to obtain paid access to a Work are available on the Site:

  1. Direct purchase of access to a Work with real money — the User pays for a specific Work at the price set by the Author and immediately receives access to it.
  2. Topping up the internal Rabbits (RabbitCurrency) balance — the User tops up their balance with real money at the exchange rate set by the Administration, and then spends the accumulated Rabbits to unlock access to Works at the price set by their Authors in Rabbits.

In both cases, payment is made in euros (EUR) via the Payment Provider, Mollie. The amount shown in the payment form on the Site, regardless of the currency or unit it is displayed in, is charged to the User's bank card or other payment instrument in euros. Payment processing takes place on Mollie's side — the Site does not receive or store the card number, expiration date, or CVC code.

Access to a paid Work or part of it is granted automatically once the Payment Provider confirms that the payment was successful — typically within a few seconds of completing the payment, though the User accepts that a short technical delay is possible.

Refunds. Access purchased on the Site is digital content provided immediately upon payment and is not supplied on any tangible medium. By making a payment, the User expresses explicit consent to the immediate provision of digital content and, to the extent permitted by applicable law, thereby loses the right to withdraw from the contract and obtain a refund once access has been granted. Rabbits already spent to unlock access to a Work are non-refundable. Any unspent balance of Rabbits may not be exchanged back for money, except where expressly required by applicable consumer protection law. If a User believes a payment was made in error, duplicated, or that access was not granted despite a successful payment, they should contact the Administration via the feedback form on the Site so the matter can be reviewed individually.

The Administration is not responsible for the Payment Provider's refusal to process a payment, for the temporary unavailability of its service, or for any fees or other conditions charged by the User's bank or payment system when making a payment.

Prices on the Site may be changed by the Author or the Administration at any time; a change in price does not affect access already purchased by a User at the previous price.

Your Obligations

By using the Site, you agree:

  • to comply with the provisions of the Agreement;
  • to provide accurate, complete, and up-to-date information when registering and to keep it current;
  • not to post advertising, spam, or unwanted messages to other Users on the Site;
  • to immediately inform the Administration of any unauthorized access to your account;
  • not to post materials that infringe the rights and legitimate interests of third parties, including copyrighted works of others without the rightsholder's permission;
  • not to register under the name of, or on behalf of, another person, and not to mislead other Users as to your identity;
  • not to upload or distribute viruses or other malicious software;
  • not to use automated tools to collect information from the Site;
  • not to collect or process other Users' personal data without a lawful basis;
  • not to reproduce, copy, or resell the Site's materials and features beyond expressly permitted use, including the automated extraction and distribution of the text of Works; the Administration may apply technical measures to restrict copying and to attribute the source of a copy;
  • not to take any action intended to disrupt the normal operation of the Site, including attempts to circumvent or disrupt the payment system;
  • to make payments only using payment instruments lawfully belonging to you or which you are duly authorized to use.

If violations are found, the Administration may restrict or block a User's account without compensation, including compensation for amounts previously paid, except where a refund is expressly required by applicable law.

General Terms of Use

By using the Site, you agree that the Administration:

  • may, at any time, refuse to publish a Work or remove it from the Site;
  • may fully or partially restrict the Site's functionality, including payment features, for technical, preventive, or other reasons at its sole discretion;
  • may, but is not obligated to, monitor materials published by Users and remove any materials that violate this Agreement or applicable law, as well as materials whose posting the Administration reasonably considers a threat to the security of the Site or its Users;
  • as a general rule, retains for a User any access to a Work previously granted or purchased even after the Author has stopped granting such access to new readers or has changed the price, unless otherwise expressly agreed.

The Site may contain links to third-party resources that are not owned or controlled by the Administration, including the Payment Provider's infrastructure. The Administration is not responsible for the content or policies of such resources and does not censor them.

Comments and Forum

The Site provides features for commenting on Works and a forum ("Boltalka"). By leaving comments or forum posts, you agree:

  • not to post insults, threats, incitement to hatred, or profanity directed at other Users or Authors;
  • not to post spam, advertising, or links to third-party resources unrelated to the discussion;
  • not to publish materials that infringe the rights of third parties or violate the law.

The Administration may, without prior notice, remove comments and forum posts that violate these rules, and may restrict or block a User's access to commenting and forum features in cases of systematic violations.

Intellectual Property Rights

Intellectual property items contained on the Site, other than Works belonging to Users — including text, software, design, graphics, and logos — are the property of the Administration or are used on a lawful basis. These materials are provided to you "as is" for personal use. Their reproduction, modification, distribution, or other use for purposes other than those stated, without the prior written consent of the Administration, is not permitted.

By posting a Work on the Site, the Author retains all rights to it.

Co-authorship. A Work may be posted as a co-authored work. Such a Work is posted by one of the co-authors; the other co-author submits a request for co-authorship through the Site's functionality, which must be accepted by the co-author who posted the Work. Once a request has been accepted, the co-author's data cannot be removed without the consent of both parties. Co-authors determine among themselves how to divide any income from the sale of access to a co-authored Work or any other benefits from its use; the Administration does not act as an intermediary in these relations, does not withhold or redistribute income between co-authors, and is not responsible for settlements between them — income from payment for access to a Work is paid in full to the Author who posted the Work and who is designated as the payment recipient on the Site.

By posting Works on the Site that lawfully belong to you, you grant other Users a non-exclusive right to use them by viewing and reproducing them solely for personal, non-commercial use — including Users who have obtained such a right on a paid basis under the "Payments and Purchases" section.

Posting a Work on the Site does not restrict the Author's right to publish it on other resources, in print publications, or to transfer or sell rights to it, unless otherwise agreed separately.

Quoting Works posted on the Site is permitted provided that the Site is credited as the source and a hyperlink to it is included.

If you believe that your intellectual property rights have been infringed by another User, please send a notice to the Administration via the feedback form on the Site. In your notice, specify: which Work or other material infringes your rights and at what address (URL) on the Site it is located; the nature of the infringement and the basis on which you consider yourself the rightsholder; your contact details for a response. The Administration will review the notice received and, if the information provided is sufficient to conclude that an infringement has occurred, will restrict access to the disputed material pending clarification of the circumstances or remove it. The author of the disputed material may be asked to provide an explanation regarding the substance of the notice.

The Author warrants that all rights to the Works they post belong to them on a lawful basis, and bears full responsibility for the materials posted, including responsibility for setting paid access to Works for which they do not hold sufficient rights.

Disclaimer of Warranties and Limitation of Liability

The Site and all information on it are provided "as is" and "as available." You use the Site at your own risk. The Administration does not guarantee uninterrupted or error-free operation of the Site, including its payment features, the complete accuracy of the information posted, or the absence of viruses or other undesirable elements.

The Administration is not liable for any incidental, indirect, or consequential damages arising from the use of the Site, access to it, or the inability to access it, including loss of data, profits, or business reputation, nor for any failures, delays, or refusals in processing a payment on the part of the Payment Provider — to the fullest extent permitted by applicable law.

Final Provisions

This Agreement and all relations arising in connection with the use of the Site are governed by the laws of the Grand Duchy of Luxembourg, without regard to conflict-of-law principles. Matters not settled by this Agreement shall be resolved by agreement between the parties, and failing agreement, by the courts of Luxembourg. If you use the Site as a consumer and habitually reside in another country of the European Union, this does not deprive you of any mandatory rights granted to you under the law of your country of residence, including rights relating to the distance sale of digital content, and does not restrict your right to bring proceedings before the courts of your place of residence, where applicable EU consumer protection law so permits. The processing of Users' personal data is in all cases carried out in accordance with the General Data Protection Regulation (GDPR), regardless of the choice of applicable law under this clause.
